Question: what is a testamentary trust?
Answer: a testamentary trust is an actual trust like a family trust. However, it only gets triggered by the death of the person creating it. It doesn't exist up until death, because the will says it will come into being on the death of the willmaker.
Question: what does a testamentary trust do?
Answer: you can delay winding up the estate. Therefore you can also protect pension entitlements, provide income tax advantages to the beneficiaries, maintain capital gains tax advantages to beneficiaries and generally protect beneficiaries against themselves and creditors.
