We are very proud of this agreement. We like the way it has a definitions section, is prepared in simple English and divides the beneficiaries into capital beneficiaries (normally the kids) and income beneficiaries (normally your partner). It is geared to maximise capital gains tax exemption by creating a life interest in favour of the income beneficiary BUT FOR INCOME ONLY. This means that the bulk of the estate is maintained in the testamentary trust for the benefit of the kids. We've even catered for a blended family (where there are kids from different marriages) and have made an effort to exclude the ex-from benefiting in any way from your will. .
