Prenuptial agreement/ deed of financial agreement

An agreement drawn pursuant to Section 90B and Part VIIIA of the Family Law Act 1975 (Commonwealth) to define a couple?s financial rights and responsibilities towards each other if their relationship ends and they separate or should one of them die. It contracts the parties out of the property adjustment and spousal maintenance provisions of Part VIII of the Family Law Act or such other legislation that may otherwise regulate their financial relationship from time to time and avoids conflict or litigation between them (or in the event of death, the members of their individual extended families) should such contingencies arise.
