Software/hardware maintenance and support agreement. Sample "A. ?a1? has been granted a licence to use software supplied by ?a4? for use with POINT OF SALES HARDWARE B. ?a4? has agreed to maintain the software for ?a1? on the terms and conditions set out in the understanding. 1. PROVISION of MAINTENANCE SERVICES ?a4? will provide ?a1? with Maintenance Services for each maintenance period for which ?a1? pays Maintenance Fee.
2. DETAILS of MAINTENANCE SERVICES 2.1 The provision of Maintenance Services means that ?a4? will, during maintenance hours:
2.1.1 promptly inform ?a1? of, and promptly rectify any failures, defects or errors in the software/hardware (whether notified by ?a4? to ?a1? or vice versa); 2.1.2 provide telephone support for ?a1? users of the software/hardware in the form of consultations, assistance and advice; 2.1.9 advise ?a1? as soon as any new versions of the software, providing major new functionality, become available."
