1. PARTIES TO AGREEMENTThis Employment Agreement is made between the Employer and the Employee.
2. DEFINITIONS2.1 ‘Award’ is described in Item 4 of Schedule 1. 2.2 ‘Cash Out’ refers to the payment in lieu of annual leave as described in clause 13.5. 2.3 The ‘Employee’ means the person identified in Item 2 of Schedule 1. 2.4 The ‘Employer’ is described in Item 3 of Schedule 1. 2.5 A ‘Full Time’ Employee is defined as one whose ordinary hours of work are 152 hours over a 4 week period and is employed on a weekly basis. 2.6 The ‘Ordinary Pay Rate’ is expressed in this Agreement as the minimum hourly rate payable for an Employee working full-time or part time (the Employer can pay more than this minimum rate). The Ordinary Pay Rate is described in Item 5 of Schedule 1. 2.7 A ‘Part Time’ Employee is defined as one who is employed on a weekly basis with ordinary hours of work less than 38 hours per week. A part time Employee will be entitled to annual leave and personal leave on a pro-rata basis according to his/her average ordinary hours of work.
