Web hosting/development agreement - COMM 39

If you control a website and you want to host the website as well then this is the agreement to use.

"1.2 In this agreement unless the contrary intention appears:

(a) Terms defined in the Application Form have the same meanings when used in these terms and conditions.

(b) A reference to this agreement includes the Application Form and each of the Schedules and Annexure to these terms and conditions and all information contained or attached to the Schedules.

1.3 Headings are inserted for convenience and do not affect the interpretation of this agreement.

3 Services to the Client

3.1 The Company will provide the Services to the Client from the Commencement Date until expiry of the Term.

3.2 The Client must immediately notify the Company of any change in details in the Application Form, including a change to the proposed Commencement Date.

3.3 The Company will use all reasonable efforts to ensure the continuity and efficiency of the Services and to achieve the service levels in the Service Specifications.

3.4 The Client may obtain a copy of the current Service Specifications on request to the Company.

3.5 The Company may vary the technical configuration or the components of the Web Site Hosting Platform at any time without notice to the Client.

4 Hosted Content

4.1 The Client will develop and install the Hosted Content and must either:

(a) Purchase and install all necessary Authoring Software to allow the transfer of the Hosted Content to the Web Site Hosting Platform.

(b) Provide the Company with a copy of the Hosted Content on disk or tape, for loading on to the Web Site Hosting

4.6 The Client must ensure that the Hosted Content does not relate to the business of a third party.

4.7 The Client must not, unless it obtains the Company?s consent, sell, resell or provide to third parties any of the Services provided by the Company under this agreement."
